Sentinel Risk Group Expands AI Risk Assessment to Address Behavioral Health Liability
November 4, 2026
bySentinel Risk Group has expanded its artificial intelligence risk assessment and governance program for medical and behavioral health practices, adding safeguards
specific to mental healthcare while addressing emerging malpractice insurance and regulatory concerns associated with clinical AI use.
The assessment examines documentation accuracy, physician oversight, patient disclosure, vendor contracts and the defensibility of AI-assisted medical coding.
According to Sentinel Risk Group, the expanded program responds partly to growing scrutiny from medical professional liability insurers over healthcare providers' use of AI.
The company cited the emergence of AI-related policy exclusions and guidance from Texas Medical Liability Trust, which recommends that practices using AI documentation tools contact their malpractice insurer, maintain appropriate business associate agreements, disclose AI use during patient consent, review AI-generated notes before signing and document staff training.
The assessment evaluates whether practices have implemented and documented these safeguards.
The expansion also introduces a behavioral health assessment covering psychiatry, psychology, counseling, clinical social work and substance use disorder treatment.
The behavioral health review addresses suicide-risk and crisis intervention safeguards, patient disclosure of AI use during therapy sessions, psychotherapy notes, consent requirements involving minors and federal confidentiality protections for substance use disorder treatment records under 42 CFR Part 2.
Sentinel Risk Group cited Illinois' Wellness and Oversight for Psychological Resources Act as an example of emerging state restrictions on AI use in mental healthcare. The law limits the use of AI to make independent therapeutic decisions or identify patients' emotions and mental states.
The company said its assessment also considers state AI laws applicable to telehealth services, including requirements in states where patients are located rather than where providers maintain their offices.
The AI Governance Shield review is conducted remotely through documentation rather than on-site inspections. It incorporates the National Institute of Standards and Technology's AI Risk Management Framework and guidance from the Coalition for Health AI, along with applicable state laws and insurance considerations.
Practices that satisfy the program's requirements receive certification, which can be verified through the company's website. Sentinel Risk Group also offers self-paced training covering healthcare AI regulations, HIPAA, recording consent and the False Claims Act.
